I asked an fwc officer and was told as long as he is of legal size and used in whole condition, it is legal.

There was an article recently in one of the fishing magazines on using Spanish as bait while trolling for billfish

Dubble: Use the 14 in makeral whole and live, not cut bait and rule is followed. I also asked FWC guy about the seabass, and as long as it is legal size and you count it towards your limit, its ok he said... I don't know about fed rules on using seabass as I never fish out that far.
