I don't care which side your on, it is Foolish to lift a rule with no plan in place. I can see revisiting it for more discussion. But to just quit enforcing is flat out stupid.

Can you think of any other law that they have just thrown out with no plan?

I'm happy to see civil discussion here but will be monitoring this closely.
Very disappointing.

Well put, bman. Remember, FFWCC is not an executive agency; it's a constitutional agency. And there is still a constitutional amendment in place that they must enforce. How it happens now is anyone's guess.

I believe the appellate court has the authority to overrule the circuit court if it finds error and may then reinstate the stay so that the rule will apply during the appeal.

How can a judge overturn and automatic stay on her order when an appeal is filed. You lawyers out there...is that legal? Judge Jackie is saying she doesn't think the appeal will overturn her ruling, and so she circumvented the process. Is she an activist judge making law from the bench now? Hmmm.

Right now we need everyone who is on the water and spots a netter to notify the FWC so they can monitor and keep track of where the damage is happening. The spotter planes are probably up and circling by now. God help the fish escape in Horn's Creek, Stoney Bayou and other popular poaching spots.

We need everybody who is on the water and spots a rec fisher to make sure and contact the FWC so they can monitor and keep track of the number of illegal fish that they keep.
God help all the fish located in JumpTrout's holes :-D and any other popular poaching spots :smt004

Surely you jest, Bman. I can think of lots of them...

1) I can remember when crossing the border without permission made one an "illegal" alien, with deportation swiftly to follow. Now we give those who break the law free education, health care, etc. Little attention / voice is given anymore to the actual law / legal methods that once helped populate this country with ambitious LEGAL immigrants seeking freedoms versus handouts.

2) I also can remember when the 4th amendment protected citizens against KGB style snooping, declaring these words "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

No shortage of others I could share, but need to get back to work to make money for the tax man. The yoke is only going to get heavier, heavier, and heavier I'm afraid for those willing to continue bearing it.

For the record, YOU asked. ;-)

Perhaps there is some chicanery afoot.
I had someone ask me if I knew where he could buy a 500 square gill net.
He said he has found many at 1000 yards but no one will cut it to 500.
If anything over 500 is still not legal, why are 1000 yard nets the norm for sale?
WHOSE FISH IS IT?

Those rec fisherman were breaking the law and should be punished, maybe trying to feed their families also. Mullet fisherman aren't looking for a few mullet, they are looking for a few thousand pounds. A netter can gill 30 trout and 6 reds in no time

I know there are rec fishermen that take over the limit and wrong size reds. I saw 2 locals go out in a little green boat in spring creek last year and pulled out 4 reds. They went back out and told me " we're going to try for a few trout now ". They passed me in the creek and when they got back to the dock, my buddy(forum member) was just getting there and he saw them unload 4 more reds. I am not saying that rec fisherman can't be scumbags and deplete the resource, but it is a lot harder to completely wipe out a fishing area with rods than w nets. Just think how quickly they can kill the fishing somewhere like bear creek boil in the winter.
