Who Gets the Ticket?

Post by Fisherman989 »

When going fishing, who in the boat gets a ticket if a guest in the boat catches a fish that is too short...and puts it in the ice chest....and is later checked by the game warden..is it the owner/operator of the boat...or is it the person that catches and keeps the fish? I have a bet on the real answer. :D

If the person that caught the fish fesses up and admits he caught it and put it in the box, he will get it. If not, I can assume the Game Warden can ticket everyone on board. Then make the case in court.

I would not wanna test them on this one. Might get a mean Judge...

Hooked :-?

I don't keep short fish it ain't worth it to me.But on my boat it is understood before the fish hits the ice that if you keep him it's your ticket we ain't splittin it. My guess is if nobody fessed up the owner/operator would get the ticket.

Short or even close to short fish don't go in my box. If you don't like my rules don't get on my boat. It just isn't worth the hassle. If all you want is a mess of fish you should go to the fish market.

I must admit it is hard to throw back a short fish that you know is dead but again the marine patrol will not listen to your story. He will just write you a ticket.

I guess it would depend on how well your friend can swim! And how far!! Personally would rather go home empty than with a short. Heck I'm an optimist - I'll always catch one bigger.

The person operating the boat when you are pulled and checked is responsible.
Otherwise, only if someone admits to the prey.

Why is the operator not responsible for the chickens?

The only chickens I've ever seen on a boat were fried or buffalo'd. Both are legal, and up to each individual on board to keep um down. (not always easy in 5' seas):-D

According to the "man" at Anky, each adult on the boat can be charged the max for each fish violation. Only the operator will be charged for other violations. My feeling is it depends on the officer.
It may be that my sole purpose in life is simply to serve as a warning to others.

Went to Aucilla River yesterday, Aug 8, 2006. Had a good day on the flats...caught some trout...some reds. Came in about 1400 hours. Loaded the boat...and left the landing. About 1 mile from the landing...on the dirt road...passed a small road into the woods..saw the Marine Patrol backed up into the road. Told my partner..."We are fixing to be checked". Sure nuff as soon as we had passed...he came out and turned the blue light on me. I stopped and got out of the van...as did my partner. We were checked for 1. Number of fish caught..looked at every one. Took them out of my ice cooler. 2. Length of every fish 3.license. Didn't have a compliance inspection.
We had 10 trout....2 reds. Both had valid license. Chatted for a few minutes....and it was over. We were on our way.
Point is....we weren't on the water. No one was fishing. The game warden was "hiding"...just like a cop behind a signboard. You are vulnerable for checking...till you get home...or cross the state line. Just 2 guys on their way home.
We were legal. :-?
