I just took the USCG class and that subject was brought up. We were told that if you accept any kind of money for a fishing trip by your fishing partners it can be considered a "for hire" trip. I assume this only applied to someone who holds a USCG License of course.

If that's the case, just get the money before you leave or after you get home. Still seems rediculous that you can't "share" expenses.

That must be the same guy that would stop a boat with 20 passengers that just got picked up off the water after a plane crash, and iving them a ticket for not having enough PFD's.

If the boat owner made a profit from the shared expenses, I "maybe" could see the point.
Friends sharing actual expense is "not for profit".

I have heard of the same thing. I think it is true, but they would have a hard time proving this among friends !

Think about the word PROFIT....
If you look at the cost of boat ownership and upkeep most guys could charge double "expenses" and still show a loss.
Splitting costs with a friend or a friend of a friend is not a business.

I contacted FWC. The PAO said this is the first he has heard of this.

I had some friends over recently for poker and steaks. Before they left, everyne pitched in on the cost of the food. Am I operating a restaurant without a license? Am I in danger of beng charged with something? If this is happening it is BULL SH....... The folks I associate with are more than willing to help out with the expenses. This is not a profit thing, it is a freaking survival thing at this point.

Here’s your answer. Both a captain and one of our lieutenants weighed in and said, no – we are not arresting people for splitting the cost of fuel, etc. You can read the last line of Lt. Nelson’s response. Where the problems will come in is hiring someone to take you out who is unlicensed.

I have not seen or heard of anyone addressing this behavior. In reading the bloggers comments, I would have to agree with the one that stated the vessel must be “for hire”.
A USCG license, along with commercial registered vessel and all the equipment associated with that business. A few friends splitting the cost for ice, bait, and fuel is not for hire.
